Freedom of Association Policy

RESOLUTION ON FREEDOM OF ASSOCIATION POLICY

Whereas, Phi Sigma Phi National Fraternity®, Inc. believes that restrictions imposed by various institutions of high education on the recruitment of members and formation of new chapters violate the rights of Freedom of Association and Equal protection Under the Law, as guaranteed by the Constitution of the United States of America, Title IX of the Educational Amendments of 1972, and the Higher Education Amendments of 1988; and

Whereas, Phi Sigma Phi National Fraternity®, Inc. believes that the practice of certain inter-fraternity Councils, or other bodies governing the activities of Greek-letters social organizations on various campuses have limited the free expansion of new, and the reestablishment of formally recognized, fraternity chapters in their campuses violate the rights of Freedom of Association and equal protection Under the Law, as guaranteed by the Constitution of the United States of America, Title IX of the Educational Amendments of 1972, and the Higher Education Amendments of 1988; and

Whereas, restrictions on and the control of Expansion, Rush, Membership Recruitment, Associate Education (or other “pledging” programs) is contrary to the welfare of the fraternity system of which Phi Sigma Phi National Fraternity®, Inc. is necessarily a part of, and

Whereas, Phi Sigma Phi National Fraternity®, Inc. believes any obligation imposed on a chapter, officers thereof, or members thereof, to comply with the above noted restrictions may cause a chapter, officers thereof, or members thereof, to violate the civil and legal rights of a prospective member.

Therefore Let it Be Resolved that the policy of Phi Sigma Phi National Fraternity®, Inc. is to oppose restrictions or controls imposed by colleges, universities, inter-fraternity councils, or other bodies governing the activities of Greek-lettered social organizations on various campuses concerning recruitment of new members, or the expansion and creation of new chapters.

Further Resolved, that every chapter and colony of Phi Sigma Phi National Fraternity®, Inc., all officers, staff, members, and/or other representatives of Phi Sigma Phi National Fraternity®, Inc. shall support the policies and expressions set forth in this Resolution; and

Further Resolved, that each chapters’ officers and/or representatives shall cast any vote, or take such action within their colleges, universities, inter-fraternity councils, or other bodies governing the activities of Greek-lettered social organizations on various campuses, in a manner that will reflect the policy of this Resolution and the intent for which it was drafted, so as to oppose any restrictions on Freedom of Association or expression; and

Further Resolved, it is the policy of Phi Sigma Phi National Fraternity®, Inc. that recruitment of new members shall be a continuous activity, and not limited to specific time restraints or conditions; and

Further Resolved, it is the policy of Phi Sigma Phi National Fraternity®, Inc. that all officers, staff, members, and/or other representatives of Phi Sigma Phi National Fraternity®, Inc. shall act as responsible members of the Greek community, campus, and community to which they belong, but only in so far as such actions do not violate the Rights guaranteed to all people by the Bill of Rights, the Constitution of the united States, or the laws if te state and/or community in which they are organized.
